Chipotle Chip Challenge Contest

OFFICIAL RULES

This Contest is only for legal residents aged 18 or older of the 50 United States (excluding Puerto Rico) and the District of Columbia only.  Void where prohibited.  Do not enter this Contest if you are not eligible and are not located in the United States at the time of entry.

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN.  PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

The Skratch Media: Chipotle Chip Challenge Contest (the “Contest”) first round will commence at 12:00:00 AM Eastern Time (“ET”) on September 17, 2024 (“Start Date”) and the final round will conclude at 11:59:59 ET on November 22, 2024 (“Contest Period”). During [JS1] the Contest Period, eligible entrants will have the opportunity to submit an “Entry” (as defined below) during “Round One”, which is scheduled to begin on September 17, 2024 at 12:00:00 AM ET and ends at 11:59:59 ET on October 11, 2024.  At the end of Round One, up to eight finalists (the “Finalists”) will be selected.  The eight Finalists will be evaluated during  round two (“Round Two”)  between 12:00:00 AM ET on October 23, 2024 and 11:59:59 ET on October 25, 2024 to select two grand prize winners (the “Grand Prize Winners”). The two Grand Prize Winners will be evaluated during round three (“Round Three”) between  12:00:00 AM ET on November 13, 2024 and 11:59:59 ET on November 22, 2024 to select one overall winner (the “Overall Winner”).

Late submissions will not be accepted.  By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of “Skratch” (as defined below).

1.     SKRATCH.  The Contest is created, sponsored, and hosted by Skratch Media, LLC, 1 PGA TOUR Blvd., Ponte Vedra Beach, FL 32082 (“Skratch”) and is brought to you with promotional support by CMG Strategy Co., LLC (“Chipotle”). For clarity, Chipotle is not the sponsor of this Contest and is not responsible for the collection of entries, selection of winners, or fulfillment of the prizes.  If you have questions about this Contest, reach out to Skratch and not Chipotle.  

2.     ELIGIBILITY REQUIREMENTS.  The Contest is open to legal residents aged 18 or older of the 50 United States (excluding Puerto Rico) and the District of Columbia only.  VOID IN ANY OTHER U.S. TERRITORIES AND POSSESSIONS, AND WHEREVER PROHIBITED OR RESTRICTED BY LAW.  Directors, officers, employees, and agents of Skratch and Chipotle and any retail licensees, authorized licensees, wholesale licensees, distributors, and each of their respective parent, sister, affiliates, subsidiaries, advertising and promotional agencies, and all other corporations, partnerships, or other legal entities or individuals associated with the development, administration, or fulfillment of this Contest (collectively, the “Contest Entities”), and the immediate families of such persons (defined as spouse, child, sibling, parent, son-in-law, daughter-in-law, grandparent, so-called “step” or “half” variations of any of the preceding individuals, and all descendants and each of their respective spouses, regardless of where they live), and those living in their same households, whether or not related, are ineligible to enter, win or collect prizes in the Contest. The Contest is subject to all applicable federal, state, and local laws, regulations, and ordinances. An Instagram, X, or TikTok account is required to enter the Contest. 3.     TO ENTER.  During the Contest Period, Skratch will publish a post announcing the Contest with information about how to enter the Contest on each of Instagram, X, and TikTok (each, a “Contest Post”).  Entrants will have the opportunity to create an original video showing their most creative “chip shot” (the “Chip Shot Video”) that complies with the “Contest Entry Criteria” (as defined below).  Entrants have the opportunity to enter the Contest up to one (1) time per social network where the Contest is offered during the Contest Period.

To enter the Contest, during Round One, follow the official @Skratch and @Chipotle on the social network (e.g., Instagram, X or TikTok), like the Contest Post on the applicable social network, and send a direct message to @Skratch with your Chop Shot Video that complies with the Contest Entry Criteria. Once entrant has completed the foregoing, entrant will have earned one (1) entry (“Entry”) into the Contest.

All Entries must be received by the end of Round One to be eligible for entry.  Incomplete, garbled, non-responsive and mechanically reproduced entries will be disqualified.  If you enter using a mobile device, standard data charges may apply from your carrier.

It is entrant’s sole responsibility to take any steps necessary to adjust their Instagram, X or TikTok account settings to permit entrant to receive messages from Skratch.  Entrant's inability to receive any message(s) from Skratch for any reason shall be deemed a failure by such entrant to comply with these rules, and any such entrant shall be disqualified from the Contest. Similarly, Skratch and/or Chipotle shall not be liable for any lost, misdirected, or otherwise unreceived or illegible messages from entrants. By entering this Contest, each entrant agrees that the Skratch may contact the entrant by direct message via entrant’s Instagram, X or TikTok or email accounts provided upon registration, to administer and fulfill this Contest.

Limit: (1) Entry per account/person regardless of platform (Instagram, X or TikTok) during the Contest. Any person, who attempts to participate by using multiple email addresses, multiple accounts on the same social network, multiple identities, or by using any device or artifice to participate in violation of the terms stated in these Official Rules, may be disqualified by Skratch in its sole discretion.

Entries will be deemed to have been submitted by the authorized Instagram, X or TikTok account holder.  The authorized account holder is defined as the natural person who is assigned to ausername by the applicable social network.  You must enter using only an account registered in your name.  The potential winner may be required to provide Skratch with proof that they are the authorized account holder of the account associated with the winning Entry.  Entries that have been generated by a script, macro, bot or any other automated means will be deemed void.  Entrants may not create or enter with multiple accounts.  Any entrant who attempts to enter with multiple accounts or under multiple identities will be disqualified and forfeits prize won, in Skratch’s sole discretion.  Entries not in compliance with these Official Rules may be disqualified in Skratch’s sole discretion.  Entries become the property of Skratch.

4.     CONTEST ENTRY CRITERIA.  In addition to the above requirements, each Entry must meet the following content restrictions (collectively, the “Contest Entry Criteria”):

·       The Entry must be your original work, created solely by you and must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright or trademark infringement.

·       the entrant should either be the only person who appears in the Chip Shot Video or, if anyone else appears in the Chip Shot Video, the entrant must obtain written permission from that person or those people to include them in the Chip Shot Video, and if Skratch asks to see the written permissions, the entrant must provide them upon request (in the event an entrant cannot provide permissions that are satisfactory to Skratch, in its sole and absolute discretion, Skratch reserves the right to disqualify the applicable Entry, or seek to secure the releases and clearances for Skratch’s and/or Chipotle’s own benefit, or otherwise allow the applicable Entry to remain in Contest);

·       The Entry must not contain sexually explicit content, violence or objectionable material that Skratch determines in its sole discretion is inappropriate, indecent, obscene, abusive, hateful, tortuous, defamatory, slanderous, libelous or offensive;

·       The Entry must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

·       The Entry must not include images that are deemed by Skratch to be obscene, pornographic, libelous or otherwise objectionable; 

·       The Entry must not contain material that is unlawful, in violation of or contrary to any applicable laws, rules or regulations.  

·       The Entry must not contain any personally identifiable information of any person other than you.  Should you include personally identifiable information about yourself in your Entry, you acknowledge and agree that such information will be disclosed publicly and you are solely responsible for any consequences thereof. 

·       The Entry must not contain any commercial content or logos.

·       The Entry may not have been previously published and must not have won previous awards.

·       Videos must be in .mp4, .avi, .mov, .m4v, .3gp, or a format acceptable by Instagram, X or TikTok.

·       High-quality, clear videos are strongly suggested.

Any Entry that is considered by Skratch in its sole and absolute discretion to violate the Contest Entry Criteria, in whole or in part, may be disqualified and will not be eligible for entry. 

5.     WINNER SELECTION AND NOTIFICATION.

Winner Selection:  At the end of Round One, assuming a sufficient number of eligible Entries are received, a judge or group of judges selected by the Skratch (in either case, the “Judging Panel”) will review the Entries that have been received and select up to eight Finalists based on the following criteria: (i) creativity (30%); (ii) execution (20%) (iii) quality and entertainment value (30%); and (iv) appropriateness to the public image of Skratch and Chipotle (20%) (the “Judging Criteria”).  If any Finalist is found to be ineligible, or if the Finalist has not complied with these Official Rules or declines a prize for any reason prior to award, such Finalist will be disqualified and an alternate Finalist may be selected.

During Round Two, the Judging Panel will evaluate the Finalists’ Entries to select two Grand Prize Winners based on the Judging Criteria.  If any Grand Prize Winner is found to be ineligible, or if the Grand Prize Winner has not complied with these Official Rules or declines a prize for any reason prior to award, such Grand Prize Winner will be disqualified and an alternate Grand Prize Winner may be selected.

During Round Three, the Judging Panel will evaluate the Grand Prize Winners’ Entries to select one Overall Winner based on the Judging Criteria.  If the Overall Winner is found to be ineligible, or if the Overall Winner has not complied with these Official Rules or declines a prize for any reason prior to award, such Overall Winner will be disqualified and an alternate Overall Winner may be selected.

In the event of a tie, the potential Finalist, Grand Prize Winner, or Overall Winner with the highest score in the “execution” category will be declared the potential winner.

All decisions of the panel of judges is final and binding. All Entries are subject to verification, confirmation and compliance with the Official Rules.  Limit: 1 winner per household.

Winner Notification:  Skratch will attempt to notify potential winners (“Potential Winners”) via direct message within approximately 1 day following the end of each round. Potential Winners must respond within two (2) days of notification attempt.  Failure to respond to notification as directed within the stated time will result in forfeiture of the prize. Awarding of any prize is subject to verification of the Potential Winner’s eligibility and full compliance with these Official Rules.  The Potential Winner will be required to complete, sign and return an Affidavit of Eligibility and Liability/Publicity Release Form (“Affidavit and Release”) within two (2) days of receiving the Affidavit and Release from Skratch.  Failure to return the signed Affidavit and Release within two (2) days following the date of delivery thereof may result in forfeiture of the prize.  If any Potential Winners cannot be contacted as specified above, or if a Potential Winner fail to return the signed Affidavit of Eligibility by the deadline specified above, or if a Potential Winner is deemed ineligible for any other reason in Skratch’s sole discretion, the Potential Winner will be disqualified and an alternate winner may, at Skratch’s sole discretion, be selected in the applicable Potential Winner’s place from among all remaining eligible Entries.  Skratch may successively attempt to contact up to two (2) potential winner(s) of an applicable prize in accordance with such procedure, and if there is still no confirmed winner(s) of such applicable prize after such attempts have been made, if any, the corresponding prize may go unawarded.

6.     PRIZE(S) AND APPROXIMATE RETAIL VALUE (“ARV”).  There will be eight (8) winners following Round One. The eight (8) Round One winners will receive twenty (20) free codes at $12/piece for a total prize valued at Two Hundered and Forty Dollars ($240.00) each. The total Round One prize valued at $1,920.00.

Two grand prize winners will receive: one (1) Round One prize, one (1) “Free Chipotle for a Year” (as defined below) prize valued at Five Hundred and Seventeen Dollars and Forty Cents ($543.40), two (2) tickets to a PGA TOUR tournament during the 2024-2025 season per winner valued at Five Hundred and Ninty Six Dollars and Twelve Cents ($596.12). The grand prize winners must select from one of the following PGA TOUR tournaments: Waste Management Phoenix Open or THE PLAYERS Championship. The grand prize will include a $2,500 stipend for use on travel and accommodation needs for attendance at the PGA TOUR tournament. Any additional expenses not covered by the stipend will be the sole responsibility of the Winner. The total ARV for each grand prize is $3,879.52. Total ARV of all the prizes to be awarded in this Contest is $9,679.04 (includes eight (8) Round One winners and two (2) grand prize winners). Tickets to the golf tournaments are subject to the terms set by the respective issuer. Prizes will be sent to addresses provided by winner after winner is verified and returns the completed Affidavit and Release.  No PO boxes permitted. Unclaimed or returned prizes will not be awarded. Skratch and Chipotle are not responsible for any legal, or other restrictions on winner’s use of the prize.

Chipotle for a Year Prize.  Each Chipotle for a Year Prize consists of Chipotle Rewards credits good for one (1) free “regular menu entrée” item per week for one year, or a total of up to fifty-two (52) regular entrée items.  For clarity purposes, “regular menu entrée item” means a burrito, burrito bowl, single order of three tacos, quesadilla (only available via the Chipotle App or on Chipotle.com), or a salad, subject to availability.  A regular menu entrée item does not include kids’ meals, 3-point meals, or single tacos.  A free Chipotle Rewards account is required to claim the prize. If a winner does not have a Chipotle Rewards account, the winner can create one for free at the time of claiming the prize.

Skratch and Chipotle are not responsible for any legal, or other restrictions on winner’s use of the prize, including without limitation travel details, transportation (including airline and ground transportation), accommodations, and restrictions or conditions for travel. Winner is responsible for any and all expenses and incidental travel costs not expressly stated herein as part of the prize. Incidental expenses and all other costs and expenses which are not specifically listed as part of the prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the winner.  If any part of the prize becomes unavailable for any reason, Skratch and/or Chipotle will not be responsible to award that part of the prize.  Winner is solely responsible for any and all applicable fees and taxes associated with receipt and use of the prize.  PRIZE IS AWARDED “AS IS,” “WHERE IS,” WITH NO WARRANTY OR GUARANTEE EXPRESS OR IMPLIED.  Prize is nonassignable, nonsubstitutable, and nontransferable.  Notwithstanding the foregoing, Skratch may, at its sole discretion, substitute cash or a prize of equal or greater monetary value.  The Grand Prize Winner will receive an IRS Form 1099-MISC for the ARV of the prize.

7.     INTERNET.  If for any reason this Contest cannot be executed as planned, including but not limited to infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Skratch that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Contest, or if the Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, Skratch reserves the right to cancel, terminate, suspend, or modify the Contest. In such event, Skratch, at its discretion, may select winner from the eligible, non-suspect Entries fulfilling the applicable eligibility requirements prior to the event requiring termination, cancellation or suspension of this Contest.

8.     LICENSE TO ENTRY.  For good and valuable consideration, the receipt and legal sufficiency of which is hereby acknowledged, each entrant (and any minor entrant’s parent or legal guardian) hereby irrevocably grants to the Contest Entities, and their successors, licensees and assigns, a non-exclusive license (but not the obligation) to reproduce, publicly perform, publicly display, stream, exploit, make derivative works of and otherwise use the Entry, in whole or in part, for any purpose, including without limitation commercial purposes, in any and all media now or hereafter devised throughout the universe in perpetuity.  The Contest Entities shall have the right, in their sole discretion, to edit, composite, morph, scan, duplicate, or alter the Entry for any purpose which the Contest Entities deem necessary or desirable, and each entrant irrevocably waives any and all so-called “moral rights” they may have therein. The Contest Entities shall retain the rights granted in each Entry even if the Entry is disqualified or fails to meet the Contest Entry Criteria or even if it determined that the entrant who made the Entry is ineligible to enter the Contest..

9.     REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION:  Each entrant (and any minor entrant’s parent or legal guardian) represents and warrants as follows: (i) the Entry does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; (ii) the Entry meets the Contest Entry Requirements, and does not and will not violate any applicable laws, and is not and will not be defamatory or libelous.  Each entrant (and any minor entrant’s parent or legal guardian) agrees to indemnify the Contest Entities and hold them harmless from and against any and all third party claims, liability, judgments, losses, damages, costs, and expenses, including penalties, interest and reasonable outside attorney’s fees and costs in the defense and disposition of such matters arising out of, resulting from, based upon or incurred because of a breach or allegation that, if true, would constitute a breach by entrant of entrant’s representations, warranties, covenants or obligations hereunder, including, without limitation, any action or statement made by entrant while participating in the Contest.

10.  PUBLICITY RELEASE:  Without in any way limiting the rights granted in the Entry, as set forth above, acceptance of a prize constitutes winner’s permission for the Contest Entities to use each winner’s Entry and the entrant’s name, social media handle, photograph, likeness, voice, biographical information, statements and address (city and state) in and in connection with advertising, marketing, promotional, and/or publicity purposes for the Contest, Contest Entities, and all uses of the Entry permitted herein, worldwide and in all forms of media and by any and all means and media now known or hereafter developed, in perpetuity, without any obligation, notice, or further compensation to the winners and each winner hereby releases the Contest Entities from any liability with respect thereto.

11.  NATURE OF RELATIONSHIP/WAIVER OF EQUITABLE RELIEF:  Each entrant (and any minor entrant’s parent or legal guardian) hereby acknowledges and agrees that the relationship between the entrant and the Contest Entities is not a confidential, fiduciary, or other special relationship, and that the entrant’s decision to provide the entrant’s Entry to Sponsor for purposes of the Contest does not place the Contest Entities in a position that is any different from the position held by members of the general public with regard to elements of the entrant’s Entry. Each entrant understands and acknowledges that the Contest Entities have wide access to ideas, stories, designs, and other literary materials, and that new ideas are constantly being submitted to the Contest Entities or being developed by their own employees. Each entrant also acknowledges that many ideas may be competitive with, similar or identical to the Entry and/or each other in theme, idea, plot, format or other respects. Each entrant acknowledges and agrees that such entrant will not be entitled to any compensation as a result of any Contest Entity’s use of any such similar or identical material. Each entrant acknowledges and agrees that the Contest Entities do not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the Entry. Finally, each entrant acknowledges that, with respect to any claim by entrant relating to or arising out of a Contest Entity’s actual or alleged exploitation or use of any Entry or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable entrant will not be irreparable or otherwise sufficient to entitle such entrant to seek injunctive or other equitable relief and entrant’s rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law.

12.  NO OBLIGATION TO USE:  The Contest Entities shall have no obligation (express or implied) to use any Entry, or to otherwise exploit any Entry or, if commenced, to continue the distribution or exploitation thereof, and the Contest Entities may at any time abandon the use of the Entry for any reason, with or without legal justification or excuse, and entrants shall not be entitled to any damages or other relief by reason thereof.

13.  LIMITATIONS OF LIABILITY AND RELEASES.  Each entrant (and any minor entrant’s parent or legal guardian) agrees that the Contest Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Contest or any Contest-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. 

No liability or responsibility is assumed by the Contest Entities from entrant’s participation in, or attempt to participate in, the Contest. The Contest Entities are not responsible for any typographical errors in the information provided by entrants, or in the announcement of prizes or these Official Rules.  Skratch’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other provision herein.  Should any provision of the Official Rules be deemed unenforceable or invalid, the other provisions of the Official Rules shall remain in full force and effect.  Proof of sending or submission will not be deemed to be proof of receipt by Skratch.  All such Entries are subject to verification.  By entering or otherwise participating in the Contest and/or accepting any prize, each entrant hereby fully and unconditionally agrees to be bound by these Official Rules and the decisions of Skratch or its respective designated agents, which are final and legally binding in all respects, and agrees to waive any right to claim any ambiguity in these Official Rules.  The entrant also agrees to assume all risk of loss, damage, destruction, delay or misdirection of materials and mail submitted to or from Skratch or Chipotle, and further agrees that all prizes are awarded upon the condition that Skratch or Chipotle and any of their respective parent companies, subsidiaries, officers, directors, partners, principals, partnerships, employees or agents (collectively, the “Released Parties”) shall have no liability whatsoever, and each entrant agrees to release, indemnify and hold harmless the Released Parties for, any injuries, losses, or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession, use or misuse of any prize, or participation in this Contest or participation in any Contest-related activities and further acknowledges that said Released Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize awarded in connection with the Contest.

Skratch reserves the right to correct any typographical, printing, computer programming or operator errors, including in the Official Rules. The Released Parties are not responsible for hardware or software failures of any kind, traffic congestion in any networks, or towers, or any combination thereof, lost network connections, incomplete, garbled or delayed transmissions, whether caused by Skratch, Chipotle, users, or by any of the equipment or programming associated with or utilized in the Contest, or by technical or human error which may occur and/or which may damage Skratch’s ability to receive or store Contest data, or which may damage an entrant’s system in connection with the selected method of entry, or which may otherwise limit any entrant’s ability to participate and/or redeem the prizes in the Contest.  In the event that any entrant’s Entry attempt is not successfully received by Skratch, that entrant’s sole remedy shall be to attempt to enter the Contest once again during the Contest Period.  Skratch reserves the right at its sole discretion, to disqualify any individual who tampers with the Contest, or the operation of the Contest, or who enters using any automatic or programmed entry duplication method, violates these Official Rules, or otherwise engages in fraudulent or offensive conduct with respect to this Contest.

BY PARTICIPATING IN THE CONTEST, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. 14.  GOVERNING LAW & JURISDICTION.  Entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant, Skratch and Chipotle and their respective agents shall be governed by and construed exclusively in accordance with the laws of the state of New York without giving effect to any principles of conflicts of law of any jurisdiction.  Entrants agree that any action at law or in equity arising out of or relating to this Contest, or awarding of the prize, shall be filed only in the state courts with jurisdiction over New York, New York, and the entrants hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. 

15.  NO X/TIKTOK/INSTAGRAM ASSOCIATION.  This Contest is in no way sponsored, endorsed or administered by, or associated with, X, TikTok or Instagram. You understand that you are providing your information to Skratch, not to X, TikTok or or Instagram.  Any questions, comments or complaints regarding the Contest must be directed to Skratch and not to X, TikTok or or Instagram.

16.  PERSONAL INFORMATION.  Skratch and its respective authorized agents will collect, use, and disclose the personal information you provide when you enter the Contest solely for the purposes of administering the Contest and fulfilling the prize, and by entering this Contest you consent to the collection, use, disclosure and management of your personal information for said purposes. 

17.  OFFICIAL RULES OR WINNERS LIST.  For the name (first initial and last name) and city of residence of the winners or for a copy of the Official Rules, send an email (must be received by November 30, 2024) to legal@proshop.inc. Include the name of this Contest “Chipotle Chip Challenge” and specify “Winners List” or “Official Rules” in the subject line.

 [JS1]The “To Enter” section made it seem like there are three open entry periods.  The “winner selection” section made it seem like the submissions received during the initial period will be narrowed down to select one final winner.  We modified the rules to be consistent with the “winner selection” interpretation.  If that’s not accurate, please let us know.
